Terms of Service
These Terms of Service ("Terms") govern your access to and use of Crescora AI, Crescora AI websites, applications, dashboards, workspaces, automation builder, APIs, web widgets, AI features, integrations, and related services ("Services").
1. About Crescora AI
Crescora AI is a no-code/low-code AI automation platform that helps businesses build, operate, and govern customer conversations and workflows across channels such as Web, WhatsApp, Telegram, email, SMS, APIs, and connected business systems.
The Services may include visual flow building, runtime automation, AI features, knowledge base tools, human handoff, agent console, analytics, billing, integrations, templates, document workflows, payments, approvals, audit logs, and governance features.
2. Eligibility and Authority
You may use the Services only if you are legally able to enter into a binding agreement.
If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms on behalf of that organization. The organization is responsible for all activity under its workspace.
3. Accounts and Workspaces
You are responsible for:
- Providing accurate account and workspace information.
- Keeping login credentials secure.
- Managing user roles, access, and permissions.
- Ensuring only authorized users access your workspace.
- Promptly notifying us of unauthorized access or security issues.
- Maintaining lawful configuration of bots, flows, templates, channels, and integrations.
- We may suspend or restrict access if we believe an account is compromised, used unlawfully, or violating these Terms.
4. Customer Content
"Customer Content" means data, text, documents, prompts, templates, workflows, bot messages, customer conversations, knowledge base content, form submissions, records, files, integrations, and other materials submitted to or processed through the Services.
You retain ownership of your Customer Content.
You grant Crescora a limited right to host, process, transmit, display, analyze, and use Customer Content only as necessary to provide, secure, support, improve, and operate the Services, comply with law, and enforce these Terms.
You are responsible for ensuring that Customer Content is lawful, accurate, authorized, and compliant with applicable privacy, sector, messaging, and consumer protection requirements.
5. AI Features and Output
The Services may include AI-powered classification, extraction, generation, summarization, routing, recommendations, guardrails, agent assist, quality evaluation, and analytics.
AI output may be inaccurate, incomplete, biased, outdated, or unsuitable for high-risk decisions. You are responsible for reviewing and approving AI outputs before relying on them, especially in healthcare, legal, financial, insurance, employment, education, safety, or compliance-related use cases.
Crescora does not provide medical, legal, financial, tax, or professional advice through the Services.
You must not represent AI output as human-reviewed unless it has actually been reviewed by a qualified person.
6. Acceptable Use
You must comply with our Acceptable Use Policy. You may not use the Services for unlawful, harmful, abusive, deceptive, exploitative, infringing, spammy, unsafe, or unauthorized activities.
We may remove content, block workflows, suspend accounts, limit usage, or terminate access if we believe the Services are being misused.
7. Channels and Messaging Platforms
If you connect WhatsApp, Telegram, email, SMS, or other messaging channels, you are responsible for:
- Obtaining required user consent.
- Following platform rules and template approval requirements.
- Respecting opt-outs and communication preferences.
- Avoiding spam or unauthorized promotional messages.
- Ensuring message content is lawful and accurate.
- Maintaining correct sender, business, and channel configuration.
- Third-party channel providers may suspend, reject, delay, or limit messages according to their own policies.
8. Integrations and Third-Party Services
The Services may connect to third-party systems such as AI providers, payment gateways, CRMs, calendars, helpdesks, messaging platforms, APIs, webhooks, email providers, and SMS providers.
You are responsible for authorizing integrations, maintaining credentials, configuring permissions, and complying with third-party terms.
Crescora is not responsible for third-party service downtime, data handling, pricing, policy changes, delivery failures, API changes, or provider limitations.
9. Billing, Plans, and Payments
Paid services may be billed through subscriptions, usage-based fees, setup fees, invoices, credits, checkout links, or custom commercial agreements.
You agree to pay applicable fees according to the selected plan, order, invoice, checkout, or agreement.
Unless otherwise stated:
- Fees are exclusive of taxes.
- Payments are non-refundable after successful activation or usage.
- Failed payments may result in restricted access.
- Plan limits may apply to users, bots, messages, workflows, AI usage, storage, channels, or integrations.
- We may change pricing for future billing periods after reasonable notice.
- If you use a payment provider such as Razorpay or another processor, their terms may also apply.
10. Trials, Beta Features, and Early Access
We may offer trials, free plans, beta features, experimental AI features, or early access modules.
These may be limited, changed, suspended, or discontinued at any time. Beta features may be less reliable and may not be covered by the same support, uptime, or security commitments as generally available features.
11. Service Availability and Changes
We aim to provide reliable Services, but we do not guarantee uninterrupted or error-free availability.
We may update, improve, suspend, restrict, remove, or modify features to improve security, reliability, compliance, performance, or product quality.
We may perform maintenance or emergency fixes without prior notice when necessary.
12. Security
We use reasonable safeguards to protect the Services. However, you are responsible for secure configuration of your workspace, channels, integrations, access roles, API credentials, and customer workflows.
You must not attempt to bypass security controls, access another workspace, reverse engineer the Services, overload infrastructure, or interfere with platform operations.
13. Confidentiality
Both parties may receive non-public information from the other party. Each party agrees to protect confidential information using reasonable care and use it only for the purposes of providing or receiving the Services.
Confidentiality obligations do not apply to information that is public, independently developed, lawfully received from another source, or required to be disclosed by law.
14. Intellectual Property
Crescora owns all rights in the Services, including software, platform design, UI, workflows engine, templates, documentation, branding, logos, systems, and technology, except Customer Content.
You may not copy, modify, resell, sublicense, reverse engineer, or create competing services using Crescora's proprietary materials except as expressly permitted.
Feedback you provide may be used by Crescora without restriction or compensation.
15. Privacy and Data Protection
Our Privacy Policy explains how we collect and process personal data.
You are responsible for ensuring that your use of the Services complies with privacy laws, consent requirements, data retention obligations, sector-specific rules, and customer notice requirements.
If required, the parties may enter into a separate data processing agreement.
16. Suspension and Termination
We may suspend or terminate access if:
- You breach these Terms.
- Payment is overdue.
- Your use creates legal, security, operational, or reputational risk.
- Your workspace is used for prohibited activity.
- Required third-party services become unavailable.
- We are required to do so by law.
- You may stop using the Services at any time. Termination does not remove obligations to pay outstanding fees or comply with continuing terms.
17. Disclaimers
The Services are provided on an "as is" and "as available" basis unless otherwise agreed in writing.
We do not guarantee that:
- AI outputs will always be accurate.
- Messages will always be delivered.
- Third-party integrations will always work.
- Workflows will be suitable for every business or regulated use case.
- The Services will be uninterrupted, error-free, or free from security risks.
18. Limitation of Liability
To the maximum extent permitted by law, Crescora will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, business interruption, reputational harm, or loss arising from third-party services.
Our total liability for any claim will not exceed the amount paid by you to Crescora for the Services in the three months before the event giving rise to the claim, unless applicable law requires otherwise.
19. Indemnity
You agree to defend, indemnify, and hold Crescora harmless from claims, damages, liabilities, costs, and expenses arising from:
- Your Customer Content.
- Your use of the Services.
- Your violation of these Terms.
- Your violation of law or third-party rights.
- Your use of messaging channels, AI outputs, integrations, or customer data.
20. Governing Law and Disputes
These Terms are governed by the laws of India.
Courts located in Hyderabad will have exclusive jurisdiction, unless applicable law requires otherwise.
21. Changes to these Terms
We may update these Terms from time to time. If changes are material, we may notify users through the website, dashboard, email, or other appropriate channels.
Continued use of the Services after changes become effective means you accept the updated Terms.
